Legal Question in Credit and Debt Law in Indiana

Summary Judgment Hearing

Last August, I enrolled in a debt settlement program. I quit paying my credit card bills as instructed. In December, I quit the debt settlement program and enrolled in a debt mgmt prog. This cc co. is now pursuing a summary judgment against me even though I am participating in this debt mgmt program and I have a letter from them stating my account is current. What do I need to expect in this hearing? They are wanting me to pay legal fees which I don't believe I should have to pay. They are the ONLY creditor doing this and prior to last August, I was ontime with all payments to them. The attorney's office has been receiving and accepting payments since January of this year. This company is also continuing to charge me 27% interest rate. Any advice you can offer is appreciated. I have stable employment and have actually increased my payment to this specific company. Thank you for your help!

Re: Summary Judgment Hearing

Debt management companies can be helpful trying to work out payment plans however they can not guarantee you protection from collections. Your creditors do not have to work with the debt management companies. What you are going through happens all too often. The only way to provide you protection from the collection and garnishment process is bankruptcy. You are protected once it is filed. You can try to offer a settlement to the company and see if they will accept that. Feel free to contact our office for a free consultation. If you need immediate assistance, please email our office or call the secondary number for after hours response.
