Legal Question in Criminal Law in Indiana

My 21 year old son was put on Probation because of a reckless driving charge. This sounds insane, but his 15 year old sister and he got into a verbal argument, which I disciplined her for but she was upset because I did "nothing" to him. So she decided to call and leave a message for his probation officer that he had violated probation, which he did not. His probation officer was on vacation at the time

To get to the point, my son is saying that his probation officer called him from vacation and set a time for him to go before the judge with her because of the phone call.

I am assuming there would have to be a legal notice sent out informing him of this ? And would it be possible for the officer to do this from vacation? I thought she would have to obtain a court date and send out a legal notification.

Can you help with this?

This is just a forum to answer questions, so we can not help defend him, if that is what you are asking. Your son needs to be where his probation officer tells him to be when he is told to be there. If an initial hearing alleging a probation violation is held, he can either hire an attorney to represent him or obtain a public defender if he can not afford to. It sounds like your daughter will now be referred to the probation department for filing of a juvenile action if what you say is true about her lying to the probation office.

I am sorry for your troubles.
