Legal Question in Criminal Law in Indiana
I am a 50 yr Black female who resides in Indiana. On 11/08/2009, I was stopped for speeding and arrested for 2 Class A misdemeanors (DUI, DWI) and 1 Class D felony!
Until this date, I had no criminal history. There were no aggarvating circumstances involving my arrest. The last traffic violation on record dated back 7 yrs, all typical traffic stops resulting in fines only. However, on the above mentioned date, this changed dragstically! I was stopped by a minimum of 10 IMPD officers and alleged of speeding! It ran like a scene from America's Most Wanted! Several officers pounced upon my vehicle beseeching me, yelling, screaming; simultaneously pounding on my driver window. Fearful and intimidated, I attempted to follow all their commands. Roll down the window, get out of the car, give me your license, answer their questions, and on and on. I had been drinking, and never denied this specific allegation. Knowing the officers at the scene were going to ARREST me! I PEACEFULLY and RESPECTIVELY submitted! Both my person and vehicle were searched at the scene without my rights been read or a search warrant being obtained. They found a partially drank bottle of vodka underneath the back passenger seat, left by a earlier occupant. I was never given any rode side sobriety tests other than a breathalizer, which officers falsely reported, I refused.
I was arrested my car impounded. When I got to court, I was assigned a Public Defender, where I discovered the full blunt of the charges and fabrications. Question: under these circumstances, how does a Black middle aged Law-a-Bidding female clear her record of such charges? Desperately seeking, Gifted and Compassionate!
