Legal Question in Criminal Law in Indiana
If someone under age 21 is at a party where there is drinking going on, but they haven't been drinking, do they get arrested - or do they get in any kind of trouble? (also does it make any difference if they've been in trouble (felony on record) with the law prior to this time...)

Is it possible they will be charged with a crime, yes. Can they be convicted of underage drinking without evidence that they have been drinking, no. Prior record does not matter in the answer to those two questions.
