Legal Question in Criminal Law in Indiana

auto theft from friend

I lent a friend my truck in December. He wrecked it and has not returned it to me as it is totalled. Before he drove the truck I told him my insurance was out of date anda he would be responsible and he agreed to it. I have not seen him since he called about the wreck, have not talked with him in a month and he will not return phone calls, voice mails, emails, texts, can I report the vehicle stolen if I lent him the truck for the day --- I have no idea where it is.

Re: auto theft from friend

How do you even know the truck was wrecked...because your (former) friend told you? Why believe him?

If you don't have any additional information, yes, you should file a report on a stolen truck, as he did not return it to you when he said he would (assuming it was just for one particular trip or for a certain period of time). If the state won't do anything, file an action for replevin, and use an attorney to help you.

Good luck.
