Legal Question in Criminal Law in Indiana
background check
I was given a background check to receive my daughter after she had been placed into foster care. The background check brought up my minor record and things that I had never been charged with. Can that be used against me and should that have showed up?

Re: background check
Juvenile records do not "disappear", contrary to popular opinion. A "background check" for foster care is designed to protect the children, and therefore may very well include things beyond mere criminal convictions. For example, if the police had visited your house seven times last year to help you locate your runaway teenager, that would be relevant even though you were not charged with anything. Whether the specific facts that were uncovered are something that should affect your fitness as a foster parent can not be answered.
