Can a borrower be charged with theft if after a year of paying on a car loan defaults and fails to return the property?

Yes, if "fails to return" means he has sold it or given it away or disposed of it in some other fashion. Not if it just means he parks it in his driveway and doesn't drive it to the bank for them.
