I bought my girlfriend an engagement ring. her 20 year old son stole all her jewelry . she will not press charges . do I have the rite to press charges

Not unless the engagement is broken off. You can then sue her for return of the ring or the money equivalent. Once you have made a gift, she can do what ever she wants, including let her son have the ring.
