Legal Question in Criminal Law in Indiana
My brother was arrested for possision of marijuana about a quarter ounce, He wants to just plea guilty, is that a good idea or should he hire an attorney? He has never been in trouble before
1 Answer from Attorneys
Many persons are so intimidated by the criminal justice system and just want to get the matter over with quickly. They therefore enter into plea agreements that they later regret for the rest of their life. Only your brother can decide what is best for him and only after consulting a local attorney who can review the charges against him. That usually involves reviewing the charging document or Information and the probable cause affidavit (which is often the same as the police incident report). If he has a criminal history, that can be important as well and should be revealed. Your brother should make an informed decision about giving up any of his rights and entering into a plea. Even if he chooses to enter a plea he should do that with and on the advice of an attorney.
