Legal Question in Criminal Law in Indiana
c felony
In February of 2003 I plead quilty to a C Felony (Battery with a deadly weapon). I am currently tring to enlist into the United States Army. The recuiter is telling me to try to get the felony reduced down of taken off my record. The lawyer that I have contacted is saying that he does not think there is much he can do. My question, is it possible to reduce the felony to a misdemener or even get it off my record?

Re: c felony
Not unless the prosecutor and the judge both agree to reduction to a misdemeanor, and even then it will probably take a petition for post conviction relief and a guilty plea to a battery misdemeanor. Only an attorney in your community can tell you whether it is realistic to ask for this level of cooperation.
Good luck.
