In Indiana in 20 years of practice I've never seen that as a charged crime - "battery with gun" for shooting someone. In Marion County that crime would be charged as attempted murder. Battery in general is touching someone in a rude, insolent or angry manner resulting in bodily injury. If your shot someone with a gun and it hit them or touched them you would be touching them in a rude, insolent or angry manner resulting in bodily injury.
