Re: Class D Felonies

In the State of Indiana, a D felony if a conviction results, has a presumptive 1 and 1/2 year sentence and if aggravating circumstances are found, up to 3 years. If you have no prior felonies, it could be suspendable. Aside from court costs, fines could range up to $10,000, but rarely do if at all.Such a conviction could also mean probation up to 3 years. Where you may fall will depend on the offense itself apart from it being a D felony, your criminal history, the particular facts of the case, the victim's input if applicable and the position of the prosecutor's office. There may even be a possibility of having it reduced to an A misdemeanor status. You should really consult with the attorney representing you who has this information about your case. If you don't have one, get one as soon as possible.
