Legal Question in Criminal Law in Indiana
Clear record from another state?
I was charged with a class D felony in 1997 in Indiana. Completed probation and restitution. The case is closed now. But can employers doing a background check see the case? I am applying for a teaching license and I don't want to incriminate myself if I don't have to. I know the state of TX (I now live here) will do a national FBI check. I did one on myself and nothing came back. I did a state of TX background check and of course nothing came back. Will the state of TX specifically check the state of IN since I got my degree there? I could have sworn part of the plea agreement was that the record would be expunged but I know it didn't happen. I am not sure how to answer the question on the application of have you ever been arrested, etc. How can I see exactly what the state of TX will see when I apply for a teaching license? Or how can I clear my Indiana record from Tx?

Re: Clear record from another state?
You need to hire an attorney in Indiana to expunge your record if that is possible. Go on the internet or contact the Star Bar Association to see if you can get a referral. Otherwise, no one can tell you what the State of Texas will see about your record, but it would be my recommendation that you tell the truth and answer all questions on the application truthfully.
