Legal Question in Criminal Law in Indiana

criminal conversion penalties

I recently got caught stealing a $46 hooded sweatshirt from a department store. I was arrested and charged with criminal conversion. I understand that is a Class A Misdemeanor. I am a 19 year old first time offender with nothing on my record, and I was wondering if you could tell me what will likely happen to me. I understand the maximum penalties, but I am wanting to know what will most likely happen? Will I go to jail, or just be put on probation and have community service? I do not have an attorney yet. I was planning on going to the initial hearing alone. Am I wrong in doing so? What will happen at the initial hearing? Also, I cannot afford an attorney, but I do work. Will the court appoint me an attorney, or make me pay for it? Thank you for the help.

Re: criminal conversion penalties

It would always seem prudent to retain counsel before any hearing in a criminal case. This shows the court that you understand the nature and importance of the matter. It could possibly even have an impact on your release and bond if that were an issue. If you ask for an appointment of the Public Defender, the court will make inquiry of you to determine if one should be appointed. While such legal representation is better than none, it should noted that the Public Defenders office is over worked with many cases really giving little time to devote to a particular case as would a private attorney.

There may be more than one option avaiable to you, possibly even avoiding conviction. A closer look at the specific facts of this case would be necessary to determine what may be available. Such a review is a must. You may really wish to consult with a private attorney first before making a decision.
