Criminal Summons re: Check Deception

I had left town for a couple of months due to a death in the family. I had written a check that did not clear the bank at a local grocery store. I called them to tell them to please resubmit the check and they agreed to do so. Unfortunately it was not redeposited and I received a Criminal Summons in the mail for Check Deception. I agree that this is my fault and the check needs to be paid. When I got back in town I went to the grocery to try to pay the check and was told I could not. I have to appear in court. Should I hire an attorney to help me with this matter? I want to pay for this and have the money to do so but I don't want it to go on my permanent record. I am scared and do not know what to do. I have never had to appear in court before and it freaks me out. What happens at the hearing? Please help. Thank you!!

Given the limited facts of your situation, I think that it would be prudent to retain legal counsel. Check deception in Indiana is a misdemeanor which carrys with it, if convicted, a possible sentence of 0 to 1 year in jail, fines from 0- $5,000 as well as probation and restitution to the victim.

Appearing in court will likely mean being taken into custody, booked and a bond set. Having the specific details before hand would be helpful to you. An attorney would be able to assist with this and get you through the system and ordeal in a sane fashion.
