Legal Question in Criminal Law in Indiana
My daughter (18) was caught at a store stealing $30.00 worth of makeup. The store called the police, but she was not arrested. The store told her that a law office would contact her and she would have to pay a fee triple the amount she was stealing. She payed this law office $100.00. She thought it was over. On a traffic stop she found out she had a bench warrent out for her arrest for conversion and went to jail. I posted bond and she goes to court soon. Why did they put a warrant out if she paid the civil liability, and was not arrested at the store?
1 Answer from Attorneys
Sounds like the prosecutor filed a criminal case against her and an arrest warrant was issued.. The $100 civil payment is unrelated to a criminal action other than the fact that she will not have to pay restitution.
