Legal Question in Criminal Law in Indiana
What would you say?
I have a domestic battery case pending. I refused a statement to the police prior to contacting an attorney. My girlfriend told the police she did not remember the details of what had happened. Should I give a statement to the police or should I let the police go on her statement alone?

I would first strongly suggest that you discuss this idea with your defense attorney. I would certainly NOT suggest you do so unless your attorney was present. Futhermore, the police have little to do if anything with a decision to dismiss the pending charge. That lies within the power of the prosecutor. If your information is helpful to your case, discuss with your attorney how it might be used in the course of the case, but DO NOT act on this without consulting him or her first. You may place yourself in jeporady without realizing it. The police are not your friend nor the prosecutor. All they wish to do is convict.
