Legal Question in Criminal Law in Indiana

Drinking and Driving: On suspended license in a fender-bender

I was in an accident the other day. At the time I had been drinking and was driving on a suspended license. I tested .08 BAC which is the legal limit in Indiana. That added an OWI (operating while intoxicated) to my list of infractions. The reason I didn't have a license pertains to a conviction of possession of marijuana that I recieved five months ago, which I am still on probation. I know I am guilty, but what can I do to reduce the sentence as much as possible. A friend of mine told me to demand a trial, then take a plea agreement just before the trial began. What do you think?

I would first suggest you not listen to your friend. Depending on all the facts of your case and where your case is pending, you may not have such an option. As you were involved in an accident this case will be more meaningful to the state. I would strongly suggest you retain an attorney as soon as possible.Keep in mind that in addition to your new offense, you are also in violation of your probation.
