Legal Question in Criminal Law in Indiana
im entering a plea bargain of cap of 270 days executed jail time.....what does this mean?
1 Answer from Attorneys
A cap of 270 days executed in a plea agreement normally means that as part of your sentence the Judge could give you up to that many days in jail. The Judge could also give you less than that and still be within the plea agreement's terms. So your sentence could be anywhere from zero days in jail all the way up to 270 days in jail. Depending on any credit time and statutory good time credit you would actually serve about half of the executed time you end up receiving. If you were to get the entire 270, it would translate to 135 actual days in jail. You should discuss any particular details like this with a lawyer before signing a plea agreement. In criminal matters if you cannot afford an attorney you can ask the court to appoint an attorney to represent you. He or she can explain this and the many other terms that usually make up a plea agreement.
