Legal Question in Criminal Law in Indiana

Expungement Of a criminal record dealing with sex crimes

Aprox 7 years ago a friend of mine was convicted of child molestation. He was 19 and she was 13. He made a plea bargain of 1 year. The sentencing judge ruled that he was not a pedifile. He has since not been in any trouble and has proceded to gain status and move up in a corporate level. My question is: can a sex crime in indiana be expunged and if it can what are the procedures that are needed to do this. Pro se? I really believe this guy deserves a second chance.

While I agree that this person does deserve a second chance, expungement is not a very easy goal to achieve in the State of Indiana.

The objection which will be raised will be by the prosecutor's office. This will be due in large part to public sentiment which has been created by that same office. Also required will be the consent of the arresting police agency.

The reason's given for the expungement while valid, still have an up hill challenge. It's not out of the question, but difficult.
