I was caught with a handgun in my car under the seat loaded without a permit to carry can I get my gun back

If you are prosecuted, probably not. If the state doesn't file charges, just ask the police (once you get a permit, that is). The worst they can tell you is no. You can not COMPEL the return, if that is your question.
