Habitual Felony Offender
is the offender automatically charged with habitual on his/hers third unrelated felony conviction? prior felonies are fraud,class D and residential trespass,class D. if convicted, the third is intimidation, classD also.

It is not automatic. It is within the disgretion of the prosecutor as to what charges to bring against a Defendant.
