When can I get my handgun back?

I was recently involved in an internet scam and have charges of Felony Theft and Forgery (which I did not commit) pending, but that is not why I am writing. When I was arrested, my handgun was in my vehicle and confiscated. I had a valid permit but washed it in the washing machine about two weeks prior. Since then I have obtained a duplicate copy of my permit from the state. Still the police will not release me my handgun? I was just wondering if they could legally hold my gun. It cost me a good bit of money and requires regular oiling so it will not rust. When may I get it back?

First be sure to consult with your attorney as every case is different and he or she should know more of the facts that this turns on. However, based on the limited information given, you may regain it after the case has been resolved. This means when the charge is dismissed or when your aquitted. Yet, keep in mind that you will most likely be required to produce some type of receipt or bill of sale showing when, where, from whom it was purchased and that it was purchased by you.
