Legal Question in Criminal Law in Indiana

Identity Theft/fraud/deception

A group of my friends are going on a trip and are flying to their destination. One of them can no longer go. I look similar to him and am going to try to use his drivers license and his plane ticket. Most identity fraud/theft/deception laws seem to state that its only a crime without permission. Since i have permission to use his ID would this still be a crime and what would the penalty be for getting caught?

Re: Identity Theft/fraud/deception

This is simply a bad idea, from beginning to end. Your friend's license is not transferable to you. If you use it to drive with or without his permission, you are driving without a license; if you use it with his permission, he is allowing you to do so and is also committing an offense. His license authorizes HIM to drive. It does not allow him to authorize you to drive.

As far as his plane ticket goes, I really can't advise on the specifics of the law butI think I'm safe in saying that using someone else's ID to board an airplane would be illegal, with or without his permission, and, as with the license, if he gave you permission he would simply be a party to it. I'm trying to imagine how you explain to Homeland Security "Well, that actually isn't me, but my friend says I can use his ID to get on the plane." They are a humorless lot, and I don't think you would enjoy what follows.

This would not be ID theft, but those laws are not the only ones that prohibit you from using someone else's identification.

Why don't you simply contact the airline and simply see if you can purchase his ticket?
