Incorrect Affidavit

What if an officer fills out an affidavit for probable cause and it has an incorrect statement that does not match his written report? Can the case be thrown out?

The best thing for you to do is to get an attorney! You may not get to trial. You can use the statement as well as the probably cause affidavit to your advantage.

Depending on the information and statements, you may want to suppress the information and evidence. Make sure you have your copies of both. Call my office if you would like to discuss in more detail.
