Legal Question in Criminal Law in Indiana
Can an Indiana Prosecutor attend same chuch that victims family and still prosecute case for murder or is that Prosecutoral misconduct ?

That would not be automatic grounds for disqualification of the prosecutor.

I don't see how merely attending the same church as the victim's family could amount to prosecutorial misconduct. Even if the prosecutor and the family are close friends there probably wouldn't be any misconduct here. Assigning a prosecutor who knows the victim's family might be unwise, but that's not the same thing as misconduct.
Besides, the fact that they attend the same church does not mean they know each other.
