Indianapolis In. What constitutes a charge of drug possession? My sister was pulled over for driving while suspended. they realized that a few years ago that she HAD a record(time served) they told her that gave them the probable cause to search her and her vehicle.w/ the Canine.in doing so, there had been an (old cleaning bottle in the back of her truck) (she does run a cleaning business, which can certainly be verified) unfortunately in one of those bottles had been an old drug pipe that her Daughter had stashed in there 6 months prior. when they arrested her, they said she was being ticketed for suspension and arrested for Paraphenilla(?) & her Bond was $100.When her Daughter came to bail her out they said they were charging her w/ possession of Drugs because of the pipe $ 500.. My ? is can she be charged for Drug possession from an old pipe? and if so can she request a copy of the Toxicology test, that must have been performed in a matter of hours to charge her w/ this crime. how much constitutes a posssession charge. keep in mind, this pipe had been in one of her Cleaning solvent bottles for over 6 months according to her Daughter.. They Harassed my sister over her past and said some very slanderous things to her. She has to be in Hamilton Co. on Wed. 11/18 to face these so called charges. what can we do?
