Legal Question in Criminal Law in Indiana
Can an inmate be transfer from jail to a mental facility?
My husband was arrested for domestic battery, and he is currently on probation in another county. So he is looking at a lot of time. My question is, is there a way that his family can get him transfered from the jail system into a long term mental health facility? He has been diagnosed with Add, and intermittent explosive disorder, and paranoid schizofrenia. My problem is that while in jail he isn't getting the psychriatic help he needs, and will never get out of the system. He really needs daily psychriatric treatment until he can learn to cope with his disability. Please let me know if there is anything we can do.

Re: Can an inmate be transfer from jail to a mental facility?
The treatment you seek must be court ordered and if the issues were raised, may be included in the court's sentencing. However, it is not likely he will be released form DOC for this purpose. He would be treated while serving his sentence in DOC.Be sure to provide his attorney with as much information as you can on his condition. You might even consider asking the court for this directly.
