i was wounder if someone can be charged of manufacturing drugs if the person was in jail at the time of the warrent to seach. also if someone can be charged for the same thing if they did not live there and was only visting the persons home for only one day.

While each case turns on it's own facts and the specific circumstances in this instance not given would really need to be reviewed, the situation described could occur.

The issue is whether a set of well articulated facts were presented to a neutral magistrate which indicated probable cause supporting a warrant being issued. The specific charged as to the would be visitor would also require review. Again if there is probable cause, this person may have been charged with conspiracy as an example.
