Legal Question in Criminal Law in Indiana
nolle prosequi
I was arrested for petty larceny in Indiana which resulted in a nolle prosequi a week later.
Four years later I was turned down by the army and marines becuase of this. They said that the matter could still be brought up.
Three more years have now passed.. Can they still open this case. Don't I have a speedy trial defense?

If you were never even charged, I would request that they specifiy what authority they have that allows a rejection on that basis. There is not even anything to "reopen" because a case never existed.
