Legal Question in Criminal Law in Indiana
If a person is arrested and appears in court the first time , do they have a right to an attorney and if they are not offered one is this a technicality that could get the case thrown out?

Yes, they have the right, no, the case will not be thrown out. If the person wants a public defender, he has to ask.
