Legal Question in Criminal Law in Indiana
plea bargain
Our son is facing class B felony charges of battery. He is 28, never been married, and has never ever spanked a child before. While babysitting his g/f's 22 month old girl, she had been sitting on the potty, she threw a remote control and hit him in the mouth, which slightly cut his lip. He lifted her off the potty and he spanked her 3 or 4 times and a little later he noticed bruising and welts. Is there any way this can be plea bargained down to a lesser charge? He has no prior record and is cooperating fully with the authorities. He has extreme anxiety and panic disorder, and the mother is aware of this. At the time he had no job due to his disorder, and therefore could not afford his medication. Main question: Can this be plea bargained?

Re: plea bargain
It depends on the district attorney. Your son is facing 6 years in prison. It seems like a harsh charge. Without knowing all the facts, it is hard to say what the prosecutor will do. Leaving welts on a baby is not going to play well in front of a judge.
