possession of marijuana
can they legally charge me with possession of marijuana when they found it not in my possession but outside of my vehicle about 5 feet away in a public gas staion parking lot

Can they CHARGE you, yes, of course they can charge you. The state will still have to prove beyond a reasonable doubt that you possessed that marijuana at a trial, and it will be much harder for them to prove that you had possessed that marijuana at some point without additional evidece, i.e. they saw you throw it away, it was found in your monogrammed handbag, or something like that.
