Legal Question in Criminal Law in Indiana
possession of paraphanelia
I got busted with paraphanelia at my house. The police made me sign a paper stating that I would make some deals for them and asked me to give them names of my friends and family members. They told me I would go to jail if I refused to do this. The paper had no judges signiture and I really don't want to do this but I also don't want to go to jail. Do they have the right to force me to make deals for them to bust my friends? What can I do to get them to leave me alone? I just want to do my time and not have to deal with all this? What is legal for them to do or not do?

Re: possession of paraphanelia
I would first urge you to retain counsel in this matter and discuss the facts of the case and issues with that person. Any information given here would at best very general based on the limited information and facts give within your e-mail inquiry. However, police often try to induce the assistance of people by similar type representations as you have indicted. Whether you were "forced" or not depends on the circumstances. Offering to withhold prosecution would not necessarily be regarded as forced as say a threat to do bodily harm. Once you have discussed all the facts and the nature of your offense with an attorney you will be better able to make decisions as to would be in your best interest. Remember, the court decides a sentence of those found guilty, not the the arresting officers who do not have legal education, a license to practice law and certainly no prosecutorial discretion to prosecute or not. Their methods are designed to appear more authoritative than what it is with idea that will intimidate one.
