Possession of stolen condiment rack: How should I plea?

A co-worker and myself were eating at a restaurant, and when we went to leave, my co-worker took the condiment rack on the table. We went out and got into my truck and a policeman stopped us and searched the truck and found the condiment rack. I was charged with posession of stolen property, which is considered a class D Felony. At the preliminary hearing, the judge said that he was going to submit a charge of not guilty, and that I was to report for a hearing in January. He suggested that in the meantime, I get legal advice. How should I plea for something like this? I have already paid out $500 in bail, is there any chance that I will be put in jail or have to pay more than that?

Given the fact that you are facing a "D" felony, I would suggest you seek out an attorney now before pleading to anything.

If convicted in the state of Indiana, you could be exposed to a presumptive sentence of 18 months in jail and possibly up to 36 months (3 years). An attorney may be able to help in a number of different ways. If the facts suggest that you would not benefit from a trial, than the skill of an attorney may make the difference in avoiding jail and possibly reducung the felony to a misdemeanor. This is an investment worth considering.

You need to contact an attorney ASAP. If the facts are as you have stated, there are some issues that we can explore. You don't want to plead to something you didn't do just to get it over with.
