Legal Question in Criminal Law in Indiana

Probation Violation

My boyfriend recently got locked up for a DUI & DWI. He was on probation before hand, so he violated his P O. When he was locked up they had a 15 day hold on him for his po violation and a bond set at $1400. After his 15 day hold was up I went and bonded him out. 3 weeks later he had a probation meeting. He went in and they locked him up again for probation violation. Does this seem right at all? Sounds like Double Jeopardy to me. They should have never let him go in the first place right? Never taken my money. Because now he has a bond of $5000 and I am already our $1400. I have a baby due in April and there is no telling when they will let him go.

Re: Probation Violation

It is not double jeopardy. Unfortunately, you didn't consult with an attorney in your community who might have been able to tell you that a second bond would probably be set eventually for the probation violation, and that paying the $1,400 might turn out to be payment only to get him out for a few days. With a baby on the way, it might be a good idea to sit down with an attorney to discuss your rights and responsibilities concerning that child before spending any additional sums of money on your boyfriend's legal situation...at least you will have all the facts and options available to you before doing anything else.

Good luck.
