Legal Question in Criminal Law in Indiana

Query

I would like to ask the procedure to handle a case?

This case is in the profession of logistic business

1. If a transporter/ sub contractor(First Party) has supplied vehicles to a transporter(Second Party) for transportation of goods without any written contract, later the second party refuses to pay the amount and give threatning to the first party, saying that if you ask for money we are going to ruin your family.

2. They have done a business for approx 90 lakh and the second party has paid 29 lakh through cheque and its been honoured.

3. Cheque for Rs. 21lakh is yet to be honoured and its been bounced.

4. The balance 40lakh is there with the second party. First party dont have any proove apart from a received letter (sub: confirmation of statement) for the director of the company.

5. Its a Partnership company.

Please advice what step should be taken and how to proceed with the case.

Note... no legal action has yet been taken.
