Legal Question in Criminal Law in Indiana
Hi, this question is involving a police report that filed today against my husband. A neighbor down the street called the police and made claims that my husband broke into her house, she said that she had a witness that watched him. All of this is untrue BTW, my husband was home with me and our children all day. In the report she claimed that her narcotic medications were stolen. The police came to my house and I allowed them to search my house all through out (without a warrant because we had nothing to hide), the witness and the lady both could not keep their stories straight on what was taken, what my husband was supposedly wearing at the time. The police found nothing in my home, as they wouldn't because my husband was innocent. In the mean time five other neighbors (that I barely even know, so they have no reason to lie to me) came to my house and told me that earlier that morning they had seen another woman go to this one ladies house and she walked out carrying several pill bottles. I was also told by several people including my landlord that this woman who is making that accusations sells her prescribtions, and that it seemed like she was pulling a form of prescription fraud by filing a police report to report them stolen in order to obtain more medications. I did call the police and gave the information that I got. I was told that the case was being turned over to a detective and I should give him that information. What can I do if she is found to have filed a false police report? Can I press charges against her or file any kind of lawsuit?

The prosecutor can decide to file charges against her, not you. A civil suit against her may be possible, if you can establish how your husband was damaged, and if the neighbor has assets to collect from. Your husband should sit down with a civil attorney in your communtiy if you wish to investigate further.
