Legal Question in Criminal Law in Indiana
I was recently cited for reckless driving(high rate of speed) by an off duty city officer out of uniform and that was driving his personal vehicle(a beat up truck) that followed my three counties away. I had my cruise control set at 55 mph. The off duty officer followed me to my home and then followed me to the hospital after I was told to go to the ER immediately in the county in which I reside, which was three counties away from where I supposedly commited the offense. I was pulled over in the hospital parking lot and surrounded by police cars. I was told that an off duty officer from another city had witnessed me driving recklessly. They ran my license and told me I could go but that I better keep my paperwork from the hospital because the off duty officer was going to file reckless driving charges against me.(He was standing in the parking lot after following me 40 miles.) Is this legal? What evidence does he have that I was speeding other than his word? He did not have radar in his personal truck. I do not have the cleanest driving record, but this seems like harassmment to me.
