Depending on the language of the Court's Order directing one to make restitution you may or may not be in violation of the terms of a plea agreement, probation or another Order of the Court. Hardship versus inability to make restitution will be a decision for the Court to make. Courts can also reduce restitution to a civil judgment. You should probably review the terms of the Court's Order directing you to make restitution to your lawyer or a lawyer in your area for more specific advice.
