Restitution Payment

I was convicted of a Felony (Theft) 18 months ago and am in the process of pay back money to a company I use to work for. I recently learned that the company I worked for file an E&O claim on the insurance and received a $10,000.00 payment. Should that reduce the amount of restitution I have to pay back to the company?

You need to contact your attorney so that he can go into court and to talk to the prosecutor and the Judge about reducing your restitution.

Generally, yes. You should contact your attorney about going into court and modifying your terms of probation to reduce the restitution amount. You might be able to accomplish this by talking to the probation officer assigned to the court your case is in. They should be able to tell you what you need to do. Would be much easier with an attorney though.

Yes. Only the judge can reduce or modfiy your restitution payments. You will need to have a hearing in front of that judge. You may need to hire a lawyer in which to handle this.
