Road Rage/Battery

Recently I was involved in a case of road rage that resulted in battery being committed on me. The person who committed the battery had first hit the rearend of my vehicle and when I stopped he ran up, opened my door and punched me in the face. When I stepped out of the van he continued hitting me and even began choking me while telling me ''He was going to kill me''. The police arrived but no immediate arrest was made, but I was told that an arrest warrant would be issued in 2 weeks. Also, this person is a member of the US marines.

Why was the person who ''battered'' me not arrested immediately?

Do I have the right to sue for monetory compensation?

Hello,

You have an action for battery against the other driver. He would have to compensate you for your damages and most likely be found to have to pay punitive damages as well. Where did this happen?
