Legal Question in Criminal Law in Indiana
My son was arrested for burglary and charged with a class B felony. There was 4 others with him and they ywas all 17 or younger. He was the only one over 18. The police took his statemen while he was under the influence of drugs and alcohol and threatned him saying that he admitted to breaking in the residential property. The police searched outr home stating the homeowners said guns was stolen. They found 5 wine bottles and a camcorder from the house they broke into. They did not take finger prints and 2 of the people that was with him in the burglary was in my house when police arrived. I was not home at the time, I was working out of town. My son has a disability, he has a learning disability and is bipolar. This was his first offense. His public defender was fired for not serving his clients, but he told my son in court to say he did not have a drug issue or a disability. I am so confused. I work with people that have disabilities. My son was given 10 years for his first offense. I am looking for someone to help me understand what his rights are. Can you please help me?? I bailed him out and 6 weeks later he was back on drugs and was arrested again. The police stated he wass breaking into cars and had stolen property on him. He was under the influence of drugs. The cop hit him in the back of his head and my son was not refusing arrest. my son had a huge knot. He was charged with 3 D felonies for receiving stolen property. The officer stated to me he hated my son and was glad he is going to prison. We have moved out of that area, but I need to know how to help my son. I have been studying law for the last few months and need some legal advise on what to do. He has a 9 month old baby and had never been in trouble until this happened. Please help me!!

The only possible advise is to get him a new lawyer. Do not try to do this on your own, or tell him what to do on his own. That would be ineffective and illegal.
