Legal Question in Criminal Law in Indiana

My son was charged with a crime during school hours at the school. The school ordered him to report to the court of where we live.When we made the attendance, No call of order made for the court.Nor any one stood. Upon sitting at the bench the judge without advising him of his rights or re assuring him of such started asking him question concerning the crime in great detail, the one comment was, "You can tell me what happended. You do not have to worry about me going somewhere else and tell someone to get you into trouble".

I have been given both ways; It can be done, no it can not be done.

Q: If this same judge is to hear the case and pass judgment of punishment upon him, can this this be a legal ? If allowed is the comments ansewers allowed into court, where the Probation Offices is pushing for confinement ?
