Legal Question in Criminal Law in Indiana
My sons vehicle was taken for a joyride one night and whoever was driving it brought it back to our house and pushed it over the hill behind out house. The police banged on our door and told us who's vehicle that was over the hill (they already knew) and where was our son. Earlier that evening our son left on his motorcycle and he wasn't home. We hadn't heard the truck start and we did not hear it come back. The police said they were in persuit of the vehicle and after searching up and down the road spotted tracks in our yard and followed them to where the truck was. The thing is, our son was not home, we have no idea who took the truck or when it was taken. We tried to contact him but couldn't get an answer on his cell phone. The problem is, our son as a record. Two DUI's. He served his sentence and has not been in trouble since but they said if he came to get his vehicle out of the impound lot, he would be arrested. They only got interested in him when they found out he had been arrested for DUI's. How can they do that when they can't identify who was driving the vehicle? He has an albi up to 1:30 am but thats it. Come to find out he was at our garage because he got caught in the rain and waited till the morning to try and get home. No cell phone connection at our shop and no land line phone. Oh, and they are not even trying to find out who actually took the vehicle.

Have you son talk to a criminal attorney. There may be other facts that he hasn't, and shouldn't talk to you about at this point.
