Legal Question in Criminal Law in Indiana

someone got on my sons yahoo account at the seymour in high school computer and sent emails to three people saying that my son was gay.l he has confessed to doing it and the local police have asked for a charge of trespass against him. The jackson county prosecutor is leaning towards this. My question is there a stronger law available in indiana that this 18 year old could be charged with like identity theft, fraud that would have a harsher penalty. The prosecutor may go with a sensativity class and a letter of apology. I do not feel that this is acceptable. Can you help me.

It is understandable that your son and you are upset. Much of the advice here starts and ends with suggesting you seek the advice of an attorney who knows and understands the area of law in which you have a problem. In your case that attorney is the elected prosecutor who represents not just your son and you but also all the people of your community. You may want to give the prosecutor's suggestions a chance. You may find that having the person who did this hear firsthand how it hurt and affected your son and letting that person honestly apologize to your son for what this person did may go a long way towards helping both boys who are becoming young men mature and grow.
