Legal Question in Criminal Law in Indiana

speedy trial

I was falsely arrested for petty larceny several years ago. The police booked me, but the judge let me go if I wasn't in trouble again. I haven't been in any trouble since.

I tried to join the marines, but they checked my record and found the arrest. They told me that the court could still bring charges if they wanted to and this would be bad for the marines.

Are the marines right? (This doesn't sound fair in time of war.) What should I do?

I would recomend that you get a lawyer and request an order of expungement from the court, assuming that you were ever convicted. If it was truly a hold open with no resolution, then perhaps a letter from the local prosecutor's office stating that the charges are resolved to their satisfaction would clear things up for the recruiters.
