Legal Question in Criminal Law in Indiana

First the story- I am a student in minnesota and I was on a trip to Indiana. While in Indiana I got caught smoking marijuana. I was charged with possession of marijuana less than 30 grams. I was given a summon for a court date in indiana. This is my first offense of this type.

The question- I am trying to get a free attorney to represent me in Indiana for I have basically no way to get down there. If I get a free attorney would I still need to be present in Indiana. All I want to do is have them put me on the diversion program to get this off my record since I no longer smoke, and care way to much about my record then about drugs. Advice on this situation would be greatly appreciated.

Yes, you need to come back to Indiana. You can't get a public defender without asking the judge for one in court. If you don't come back, a warrant will be issued for your failure to appear.
