Unfair Plea Bargain?
A friend of mine entered into a plea bargain in 1997, in which the prosecuter agreed as part of the plea bargain, to drop three felony charges. In September of 2000, he entered into another plea bargain for charges unrelated to the previous plea bargain. However, the prosecuting attorney used the used the same three felony charges from 1997 as part of this plea bargain. Is this allowed? I thought that once the prosecuter's office dropped charges as part of a plea agreement, they could not be used again in another case?

Your friend's case bears close examination. He or she should bring this to the attention of his/her attorney for review. Until all the facts are known it is difficult to really make any call on this.
