Legal Question in Criminal Law in Indiana
I work for a company that takes care of the mentally and physically impaired. Recently, a client came up with a few burns on his body that were decently severe. He only has a few staff that take care of him at a time...including me. I know 100% that i DIDN'T do it, and i don't have a criminal history. However, my company reported it to the police and now a criminal investigation is being held. I and a few others involved are being layed off temporarily until some sort of resolution comes along. Whether it be that someone is found guilty, or insufficient evidence leads to a case dismissal. I have been interviewed by the police and so have the other co-workers. Everyone has stated that they don't know anything, including me. Im the one that reported seeing the marks or burns though. Filled out all of the company paperwork needed and contacted my boss about the discovery immediately. The police wanted to conduct a polygraph test, but i said NO because i have done my research on them and they are definitely not conclusive of anything nor 100%. I want to guard my innocence. During the interview with the police, the officer got a little nasty saying..."Everyone elses stories are "good"", "I know you did it!" That kinda upset me a little, but i think its just apart of their interrogation practice. I've never been in trouble with the law, so obviously this whole ordeal has got me nerved up quite abit. As far as i know....there are NO witnesses, NO video or audio and obviously the client who was hurt can't testify to anything because he's not capable because of his disability. So far....all there is is hearsay and me refusing the polygraph. I know they need probable cause to arrest me or convict me, but i didn't do it! Just because of hearsay and me refusing a polygraph...is that enough for them to arrest me? Charges can't be pressed can they? Do they really have anything else to go on? I don't think they really do. I just look more guilty to them because i refused the polygraph exam, but im exercising my rights and i definitely don't trust my innocence to one of those untrustworthy exams! I'd appreciate help with this. Thank you very much!

Yes, they can arrest you based on what witnesses say. A polygraph is usually not a good idea. Find an attorney in your community who can marshall all of the facts and advise you best.
